The terms and conditions explain the nature and scope of the relationship between Loyalty Solutions & Research Pvt Limited here in refered to as "LSRL" (as owner and management for the program) and a member of i-mint. The terms and conditions cover limitations and exclusions on the liability of LSRL, i-mint and the i-mint merchants.

 

1 Definitions

In these terms and conditions, unless the context specifies otherwise:

"Affiliate" means and includes any company (a) which is the holding or subsidiary company of LSRL or (b) a person under the control of or under common control with LSRL, or (c) any person, in 50% or more of the voting securities of which LSRL has a direct or beneficial interest or control.

"Control" together with grammatical variations when used with respect to any person, means the power to direct the management and policies of such person, directly or indirectly, whether through the ownership of the vote carrying securities, by contract or otherwise howsoever.

"LSRL" shall mean Loyalty Solutions & Research Pvt Limited and such expression shall, unless it be repugnant to the subject or context thereof, include its successors, assigns, representatives and transferees.

"Customer" for this program means customers of LSRL and customers of group companies of LSRL or any other person as may be decided by LSRL from time to time.

i-mint Means the i-mint customer rewards program, managed and operated by LSRL offering benefits, facilities or arrangements to members by reason of their membership into the program, whereby certain i-mint points are accumulated on every earn activity made by members within i-mint network & such i-mint points may be used by the member for redemption through the i-mint rewards catalog.

i-mint Member means a customer as defined above, who is enrolled as a member of i-mint holding a valid i-mint card/membership no. Membership to this program is governed by rules set by LSRL for this program and are subject to change.

i-mint Membership account means the account where the member's i-mint points will be accumulated.

"Primary member" is the member who owns the i-mint membership account and controls all redemptions on it as well. Card held by the primary member is known as the 'primary card'.

"Add-on members" are additional cardholders on primary members' account. A primary member can issue cards to his immediate family. 'Immediate family' is limited to spouse, children, father, mother, brother and sister residing at the same address as that of the primary member.

i-mint Card means a i-mint customer rewards program card. This card shall be the property of LSRL where a unique membership id is given to every member.

i-mint Point is the unit currency for the program. Members' are awarded i-mint points for earn activities within the network.

i-mint Merchant means any or all of the present or future entities, merchants, shops, departmental stores, airlines, hotels, restaurants, car rental companies and other participating establishments, whether with online or offline presence, in agreement with LSRL, where members can accumulate i-mint points for purchase of goods and services.

i-mint Network means all the i-mint merchants and LSRL for the time being taken as a whole.

"Earn activity" means any activity, which results in accruing of i-mint points to a member as specified in clause 4.

"Redemption" means any activity, which results in exchange of i-mint points by a member for i-mint rewards, as specified in clause 5.

i-mint Rewards catalog means the periodical rewards catalogue issued by LSRL for this program containing the particulars or rewards currently available in the program and the number of i-mint points required for them.

i-mint Rewards means the rewards issued by LSRL as enlisted in the i-mint rewards catalog and/or as communicated from time to time.

2 General Conditions

2.1 Membership into i-mint is voluntary, open to customers with a valid mailing address in India above the age of 18 and eligible as per the rules laid down by business. These rules are subject to change.

2.2 An i-mint membership is valid for lifetime of the member unless terminated in terms thereof.

2.3 An i-mint card is not a credit card or a debit card or a discount card or a prepaid card. It is not a payment instrument.

2.4 i-mint membership, i-mint card and i-mint points are non-transferable except as specified in this terms and conditions.

2.5 Members will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of benefits, facilities or arrangements provided or made available to a member, by an i-mint merchant, as a result of his/her membership.

2.6 i-mint card at all times remains the property of LSRL, which reserves the right at any time in its absolute discretion and without giving notice to such member to withdraw the membership and benefits arising out of the same. The member must return or destroy his/her i-mint card without delay whenever requested by LSRL.

2.7 LSRL will endeavor to see that the services, benefits, facilities and arrangements as expressed or advertised by the i-mint merchants will be available to the members. LSRL will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision whether whole or part, of any such services, benefits, facilities or arrangements.

2.8 When a member seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the i-mint merchants, the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the provider of the said benefits, facilities and arrangements.

2.9 Members shall provide such information as may be required by LSRL from time to time.

2.10 The program of i-mint may be modified at the sole discretion of LSRL from time to time without intimation to the member.

2.11 LSRL shall not be liable in the event it fails to fulfill any of its obligation under this agreement due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.

2.12 A waiver of any of the terms and conditions by LSRL shall not be deemed to be a continuing waiver, but shall apply solely to the instances to which the waiver is directed.

2.13 i-mint card shall be serviced and accepted only at locations identified in the list provided to the members or at the website. i-mint can at any time without intimation to the customer add and / or delete merchants from such list. The same shall be updated on the website within a reasonable time.

2.14 Members are required to inform all location changes/address changes to LSRL immediately.

2.15 LSRL will not be responsible for non-serviceability due to member moving out of serviced areas.

2.16 All point dispute complaints older then 2 months will not be entertained.

3 Enrolment in i-mint

3.1 Only customers residing in cities where i-mint has been launched or those who have a valid mailing address in such cities are eligible to enroll into i-mint.

3.2 It is the members' responsibility to share the correct communication details with i-mint at the time of enrolling into the program.

3.3 Customers can enroll into i-mint program through the LSRL's call center or website, by sharing mandatory details.

3.4 LSRL shall reserve the right to offer i-mint by invitation to any customer as it may deem fit.

3.5 Customers can also choose to purchase non-personalized kits (retail kit) 'over the counter' from various outlets, as decided by LSRL, where these will be made available by the LSRL.

3.6 Only one primary card (implying one primary membership) per individual will be accepted.

3.7 If a member holds more than one i-mint card, it is the duty of such member to call our customer care and request for an account aggregation. LSRL on such request shall cancel that card(s) which the customer does not want to retain and transfer the i-mint points, earned if any, into a single primary account / card number.
It is not allowed to obtain more than two i-mint cards from the same partner participating in the program. If a member holds more than two i-mint cards from the same partner, LSRL in its absolute discretion will take necessary corrective action(s), with or without notice to such member.

3.8 Membership to i-mint is at the sole discretion of LSRL and it may refuse membership to any applicant without assigning any reasons.

4 Use of i-mint card and membership

4.1 LSRL at any time, without giving notice, change, modify and/or vary the terms and conditions of i-mint.

4.2 The member agrees that by using i-mint card and by quoting his/her membership number to LSRL and/or to any i-mint merchant, he/she has read and understood the prevailing terms and conditions of i-mint and confirms that he/she is bound by such terms and conditions and voluntarily agrees to pay all specified charges.

4.3 By using his/her i-mint card and/or quoting his/her i-mint membership number to LSRL and/or any i-mint merchants, a member consents to LSRL creating, maintaining and updating data about the member. Such data may include membership data (like name, address, telephone number, date of birth, employer, areas of interest, preferences etc.) Usage data (including without limitation, transactions and i-mint points accrued at various i-mint merchants, etc.) And data concerning contacts with LSRL (including without limitation, enquiry regarding membership) and will be maintained and updated for the purpose of providing relevant information and services to the members.

4.4 LSRL shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of i-mint or any of its facilities, benefits or arrangements which are made available to members, including without limitation, i-mint merchant's withdrawal or the withdrawal or limiting of any such services, benefits or facilities.

4.5 If any member loses the i-mint card, the member must inform LSRL immediately. Till such time the loss has been reported to LSRL, LSRL shall not be liable for any losses incurred by misuse of such i-mint card. A new i-mint card after blocking and cancellation of the old i-mint card will be issued to such member on request. All i-mint points accumulated by the member on the old i-mint card will be transferred to the new i-mint card.

5 Accrual of i-mint points

5.1 Members can accrue i-mint points through a transaction with i-mint merchant for the purchase of goods or services paid by cash, credit/debit card, cheque, online payment, standing instruction or any other means of payment agreed upon by the i-mint merchant.

5.2 Members will also be awarded i-mint points for non-transactional activities as communicated from time to time through the website or through printed brochures or through any other means of communication.

5.3 i-mint points awarded may vary between different i-mint merchants depending on the arrangement LSRL has with the merchant.

5.4 To accrue i-mint points, the member must present his/her i-mint card or i-mint card number at the time of completing the earn activity and credit of i-mint points. If a member fails to present the i-mint card or i-mint card number when visiting or on availing such services, this may result in the applicable i-mint points not being accrued by the members and LSRL or its i-mint merchant shall not be responsible in this regard.

5.5 The method of earning i-mint points from i-mint merchants is subject to change from time to time.

5.6 Accumulation of both i-mint points and any other parallel rewards program points (of which the merchant may be a part) for the same transaction is at the sole discretion of i-mint merchant.

5.7 i-mint merchants may change any of the terms and conditions of their business at any time without notice to the i-mint member or to i-mint program. LSRL is not responsible for informing members of any such changes.

5.8 All members are required to obtain and preserve for a period of 180 days appropriate documentation for all transactions done with i-mint merchants that earn i-mint points. It is the member's responsibility to ensure that an EDC generated transaction slip of the correct amount and details of the transaction is provided to him/her at the time of transaction.

5.9 LSRL has no liability for the acts and omissions of the i-mint merchants.

6 i-mint points calculation

6.1 i-mint points accrued through transactions at i-mint merchants shall be credited to member's account within 7 working days.

6.2 i-mint points accrued through any other earn activity shall be credited to member's account within such period as is mentioned for such activity.

6.3 i-mint points credit is not applicable for the following: (i) returned & refunded goods and services, forfeited and unused services. (ii) goods or services acquired by using i-mint points.

6.4 Points are granted in whole. Customers will not be awarded points in fractions. Points will get rounded off to the nearest whole number.

6.5 i-mint points are valid for a period of three years or any other notified date. Points earned during any quarter of the year shall expire (on fifo basis) on completion of 3 years from the end of the quarter. Thus points earned during 1st july 2005 to 30th sept 2005 shall get expired on 1st October 2008.

6.6 In the event of the member not using his/her i-mint card to accumulate and/ or redeem
i-mint points for a continuous period of 24 months (2 years), the accumulated i-mint points and the i-mint membership account will expire. All points accumulated on such accounts and lying unused at the time of expiry shall lapse.

6.7 i-mint points from the member's account cannot be pooled or combined with the i-mint points of another member's account.

6.8 In case of earn activity with any i-mint merchants who participate in more than one program, subject to the consent of the i-mint merchants, the members are eligible for credit of points in more than one program.

6.9 Complaints on points not credited to account from any partner / merchant will be entertained only if the date of transaction is not older than 2 months.

7 Transfer of i-mint points

7.1 i-mint points are not negotiable, transferable or redeemable for cash. At no time may i-mint points be credited to or i-mint rewards request be issued to, purchased by, or sold to or otherwise transferred to any person other than the member. Any such i-mint points or requests for i-mint rewards are void if transferred for cash or other considerations. Any person who commits such acts is liable for damages, litigation and related costs to LSRL, which reserves the right, to terminate membership or remove such persons from i-mint network.

8 i-mint points statement, program updates & notices

8.1 Members can call the i-mint member care nos. Or register on www.imint.in in the member login section for obtaining an update of the i-mint points accumulated and/or used for i-mint rewards.

8.2 Any notice, information, intimation, change, modification, alteration of these terms and conditions or i-mint rewards catalog shall be deemed to have been given to the member after expiry of seven days, if notice is sent by pre-paid post to the last intimated address of the member or forthwith if posted on the website.

9 Redemption of i-mint points

9.1 i-mint points could be redeemed against the i-mint rewards catalog.

9.2 LSRL will maintain an i-mint rewards catalog on the website specifying the products and services which would be available for i-mint rewards against i-mint points accumulated by a member. Redemption against i-mint rewards catalog can happen by approaching the call center and placing a redemption request and/or through login in the i-mint website, when available.

9.3 All the items featured in the i-mint rewards catalog and/or informed by LSRL are subject to availability and suppliers warranties and restrictions at the time of claiming the i-mint rewards. In case an item selected by the member is not available, members will be required to select from the other available items from the i-mint rewards catalog. LSRL provides no warranty whatsoever with respect to those items or for their suitability for any purpose.

9.4 i-mint rewards once requested cannot be canceled or withdrawn or changed and the i-mint points used for the same cannot be reversed.

9.5 On receipt of the i-mint rewards request by LSRL through call center, website or otherwise, i-mint points will automatically be deducted from the accumulated i-mint points in the members account.

9.6 All reasonable efforts would be taken by LSRL to ensure that i-mint reward requests are fulfilled within 12 days of the receipt of the same at the call center or otherwise. LSRL will not be liable for any delay beyond the time period specified herein.

9.7 All requests issued for i-mint rewards are subject to any statutory regulations, rules and restrictions, if any.

9.8 i-mint rewards have no monetary refund value.

10 Termination of i-mint membership

10.1 A member may terminate his/her i-mint membership by calling the call center of the LSRL and requesting for termination.

10.2 Misuse of i-mint card or the membership benefits may result in termination of membership or withdrawal of benefits at the sole discretion of LSRL.

10.3 Disqualification of a member, arising out of his/her misconduct, fraud and misuse of i-mint rewards or acts in a manner inconsistent with any central/state/local laws, statutes or ordinances, may result in immediate termination of i-mint membership and cancellation of all i-mint points and i-mint rewards. Any member so disqualified shall not be entitled to redeem his i-mint points after such disqualification.

10.4 Upon the death of a member, his/her i-mint membership account will be closed and all outstanding i-mint points will lapse.

11 Miscellaneous

11.1 Settlement of disputes: terms and conditions, set herein, shall be governed by the laws of India only. All disputes arising under the terms and conditions subject to the exclusive jurisdiction of the competent courts in mumbai only. All claims and disputes arising under the terms and conditions should be notified to LSRL within 180 days after which no member shall have any claim against LSRL.

11.2 Changing these terms and conditions: LSRL reserves the right to change, at any time, these terms and conditions, features and benefits offered on i-mint.

11.3 LSRL shall have the right to transfer, assign and sell in any manner, in whole or in part, i-mint to any third party of its choice without reference or intimation to the members.

11.4 LSRL reserves the right to disqualify any person from further participation in i-mint if in LSRL's sole judgment such person has violated the terms and conditions specified herein.

11.5 i-mint membership enrollment and eligibility, earning i-mint points, claiming i-mint rewards, availability of i-mint rewards and redemption are subject to the terms and conditions herein and are subject to any applicable laws and regulations.

11.6 LSRL reserves the right to terminate i-mint, by giving one month's notice.

11.7 Upon termination or withdrawal of i-mint, all members will be given 30 days time within which they may use the i-mint points in their account to request for i-mint rewards, after which the i-mint points will lapse.

11.8 LSRL and i-mint merchants shall not be liable to any member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with i-mint, including the functioning of the helpline and/or the website, and/or provision or the refusal to provideh any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether LSRL and/or any of its i-mint merchants have any control over the circumstances giving rise to the claim or not.

12 Customer must always carry the i-mint card securely and should not share the information pertaining to his i-mint membership with anyone.

13 i-mint will not ask for customer password and other details through any e-mail or SMS. Please beware of spam mails and phishing and do not share your account details with mail id which appear to be coming from unauthorized sources.

14 In case a customer loses the i-mint membership card, a penalty of 50 points will be deducted from his / her points account in-case he / she wants a fresh card to be issued.

15 Customer must report the lost card details to the i-mint call center. Once a card is reported lost, it will be blocked and under any circumstances it will not be unblocked.

16 A fresh card can be issued to customer only when he / she verifies the other details of the account by calling up the call center. In case the customer fails to verify the details, the right of refusal for issuing the fresh card will remain with LSRL. No claims on such cases will be entertained.

17 Customer must call up the call center numbers to request for a fresh card. Requests on mail or other communication will not be entertained.

18 Customer must provide his complete name, address and other details while applying for a fresh card.

19 To combine his points from previous card to the new card, he / she will have to call up the call center and request for merging of points from one account to another. For more details on the process, a customer may call up the call center and understand the process better.

Redemption terms and conditions

1 Definitions

i-mint means the i-mint customer rewards program, managed and operated by Loyalty Solutions and Research Pvt Ltd (LSRL) offering benefits, facilities or arrangements to members by reason of their membership into the program, whereby certain i-mint points are accumulated on every earn activity made by members within i-mint network & such i-mint points may be used by the member for redemption through the i-mint rewards catalog.

2 Warranty / Guarantee

2.1 The warranty and guarantees as applicable on the products/vouchers is the sole responsibility of the vendors supplying the product or service. LSRL shall not be liable or responsible for any defect in the product. However guarantee and warranty of the product shall be transferred as received from the manufacturer or distributor. Customer must contact the respective manufacturer / vendor in case of any product complaint.

2.2 All products/vouchers featured in LSRL's rewards catalogue are subject to availability of the goods and supplier warranties/restrictions at the time of redemption. LSRL gives no warranty (whether expressly or implied) whatsoever with respect to the product /services acquired under the program or through other partner loyalty program. In particular, LSRL gives no warranty with respect to quality of goods acquired or their suitability for any purpose.

2.3 LSRL is not responsible for the actual experience for any experience related reward. This responsibility lies directly with the vendor who is facilitating this experience.

2.4 Gift vouchers featured in the rewards catalogue always carry a validity period, post which these vouchers will not be honoured.

3 Product Delivery

3.1 All redemptions orders will be delivered within 10 working days unless the delay is due to conditions beyond the control of LSRL.

3.2 Redemption orders from members once given to LSRL cannot be canceled or withdrawn or changed. Goods / rewards once delivered cannot be returned or cancelled by the member.

3.3 In case of flowers or perishable products the cost of the returned goods will be borne by the member.

3.4 For all website orders, please ensure the mailing address details are correct. If not, please contact i-mint Call Center and have the details updated.

3.5 If a member has not given correct address or is not available at the mentioned address at the time of delivery, product will be delivered to the person available at the given address.

3.6 If LSRL team does not receive any complaint of non-receipt of redeemed items within 20 business days from the date of redemption, it shall be taken that the member has received the redeemed items.

4 Return / Exchange Policy

4.1 Any damaged products need to be notified to the i-mint call centre within 3 days from the product received date, post which complaints will not be entertained.

4.2 All damaged products need to be shipped back by the customer. Customer will have to ship the damaged product back to a location which he/she should confirm with i-mint Call Centre.

4.3 LSRL will not be responsible for products or vouchers stolen, damaged or lost in transit before delivery to the member. This responsibility entirely lies with the fulfillment agency and Courier Company which is used for fulfillment of the reward. LSRL will address all such complaints subject to establishing the authenticity of such cases and review.

4.4 Member must strictly follow the partner's and merchant's designated procedures to exchange defective rewards or merchandise. Under no circumstances will the rewards be refunded or exchanged for i-mint points or cash.

4.5 Points for the returned products due to damage will be refunded to customer's account within 15 days from the Returned date of the product.

5 Indemnity

5.1 Availability of the products and points required for redemption in i-mint rewards catalogue are subject to change without prior notice.

5.2 All products sent will be as per the description mentioned in the redemption catalogue, although there might be slight change in the model, color or features of the product.

5.3 Travel rewards are subject to availability and normal airline conditions of carriage.

5.4 Selection of products offered for redemption is and will be at the sole discretion of LSRL and is liable to change without prior notice.

5.5 LSRL will not be held responsible where any supplier of products withdraws, cancels, alters or amends those products.

5.6 LSRL is not responsible for changes to, or discontinuance of, any merchant or partner product, merchandise, or service, any merchant or partner withdrawals from the LSRL program, or for any effect on or devaluation of rewards caused by such change, discontinuance, or withdrawal. Members may not rely upon the continued availability of any reward or award level.

5.7 LSRL will not be held responsible where any supplier of products withdraws, cancels, alters or amends those products.

5.8 Product image displayed on the rewards catalogue are indicative. Colors and specifications of products are subject to change as per the availability.

6 Other Terms & Conditions

6.1 On redemption, i-mint points would automatically be removed from accumulated points in the member's account.

6.2 Points are redeemable only against products, vouchers or services as featured in rewards catalogue.

6.3 Information supplied by the i-mint member on the redemption of certain rewards may be used by LSRL or the service establishments that provide the rewards for administrative or marketing purposes or such other purpose as LSRL may determine.

6.4 Selection of products offered for redemption is and will be at the sole discretion of LSRL and is liable to change without prior notice.

6.5 LSRL reserves the right to change or cancel the LSRL's program without prior notice. Redemption claims submitted prior to the effective date of the change or cancellation of the LSRL's program will still be honoured within a 90-day time limit.

6.6 In the event of a dispute between LSRL and member on the gift item ordered, the decision of LSRL shall be deemed as final and binding.

6.7 All logos & trademarks are owned by the respective companies.

6.8 LSRL also reserves the right to change and modify the terms and conditions at any point in time without prior notice to members.

8.1 Membership into i-mint is voluntary, open to customers with a valid mailing address in India above the age of 18 and eligible as per the rules laid down by business. These rules are subject to change.

8.2 An i-mint membership is valid for lifetime of the member unless terminated in terms thereof.

8.3 An i-mint card is not a credit card or a debit card or a discount card or a prepaid card. It is not a payment instrument.

8.4 i-mint membership, i-mint card and i-mint points are non-transferable except as specified in this terms and conditions.

8.5 Members will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of benefits, facilities or arrangements provided or made available to a member, by an i-mint merchant, as a result of his/her membership.

8.6 i-mint card at all times remains the property of LSRL, which reserves the right at any time in its absolute discretion and without giving notice to such member to withdraw the membership and benefits arising out of the same. The member must return or destroy his/her i-mint card without delay whenever requested by LSRL.

8.7 LSRL will endeavor to see that the services, benefits, facilities and arrangements as expressed or advertised by the i-mint merchants will be available to the members. LSRL will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision whether whole or part, of any such services, benefits, facilities or arrangements.

8.8 When a member seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the i-mint merchants, the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the provider of the said benefits, facilities and arrangements.

8.9 Members shall provide such information as may be required by LSRL from time to time.

8.10 The program of i-mint may be modified at the sole discretion of LSRL from time to time without intimation to the member.

8.11 LSRL shall not be liable in the event it fails to fulfill any of its obligation under this agreement due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.

8.12 A waiver of any of the terms and conditions by LSRL shall not be deemed to be a continuing waiver, but shall apply solely to the instances to which the waiver is directed.

8.13 i-mint card shall be serviced and accepted only at locations identified in the list provided to the members or at the website. i-mint can at any time without intimation to the customer add and / or delete merchants from such list. The same shall be updated on the website within a reasonable time.

8.14 Members are required to inform all location changes/address changes to LSRL immediately.

8.15 LSRL will not be responsible for non-serviceability due to member moving out of serviced areas.

8.16 All point dispute complaints older then 2 months will not be entertained.

9 Enrolment in i-mint

9.1 Only customers residing in cities where i-mint has been launched or those who have a valid mailing address in such cities are eligible to enroll into i-mint.

9.2 It is the members' responsibility to share the correct communication details with i-mint at the time of enrolling into the program.

9.3 Customers can enroll into i-mint program through the LSRL's call center or website, by sharing mandatory details.

9.4 LSRL shall reserve the right to offer i-mint by invitation to any customer as it may deem fit.

9.5 Customers can also choose to purchase non-personalized kits (retail kit) 'over the counter' from various outlets, as decided by LSRL, where these will be made available by the LSRL.

9.6 Only one primary card (implying one primary membership) per individual will be accepted.

9.7 If a member has been issued more than one i-mint primary card, it is the duty of such member to inform LSRL immediately and request for an account aggregation. LSRL on such request shall cancel that card which the customer does not want to retain and transfer the i-mint points, if any, earned on such card on to the other i-mint card.

9.8 Membership to i-mint is at the sole discretion of LSRL and it may refuse membership to any applicant without assigning any reasons.

10 Use of i-mint card and membership

10.1 LSRL at any time, without giving notice, change, modify and/or vary the terms and conditions of i-mint.

10.2 The member agrees that by using i-mint card and by quoting his/her membership number to LSRL and/or to any i-mint merchant, he/she has read and understood the prevailing terms and conditions of i-mint and confirms that he/she is bound by such terms and conditions and voluntarily agrees to pay all specified charges.

10.3 By using his/her i-mint card and/or quoting his/her i-mint membership number to LSRL and/or any i-mint merchants, a member consents to LSRL creating, maintaining and updating data about the member. Such data may include membership data (like name, address, telephone number, date of birth, employer, areas of interest, preferences etc.) Usage data (including without limitation, transactions and i-mint points accrued at various i-mint merchants, etc.) And data concerning contacts with LSRL (including without limitation, enquiry regarding membership) and will be maintained and updated for the purpose of providing relevant information and services to the members.

10.4 LSRL shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of i-mint or any of its facilities, benefits or arrangements which are made available to members, including without limitation, i-mint merchant's withdrawal or the withdrawal or limiting of any such services, benefits or facilities.

10.5 If any member loses the i-mint card, the member must inform LSRL immediately. Till such time the loss has been reported to LSRL, LSRL shall not be liable for any losses incurred by misuse of such i-mint card. A new i-mint card after blocking and cancellation of the old i-mint card will be issued to such member on request. All i-mint points accumulated by the member on the old i-mint card will be transferred to the new i-mint card.

11 accrual of i-mint points

11.1 Members can accrue i-mint points through a transaction with i-mint merchant for the purchase of goods or services paid by cash, credit/debit card, cheque, online payment, standing instruction or any other means of payment agreed upon by the i-mint merchant.

11.2 Members will also be awarded i-mint points for non-transactional activities as communicated from time to time through the website or through printed brochures or through any other means of communication.

11.3 i-mint points awarded may vary between different i-mint merchants depending on the arrangement LSRL has with the merchant.

11.4 To accrue i-mint points, the member must present his/her i-mint card or i-mint card number at the time of completing the earn activity and credit of i-mint points. If a member fails to present the i-mint card or i-mint card number when visiting or on availing such services, this may result in the applicable i-mint points not being accrued by the members and LSRL or its i-mint merchant shall not be responsible in this regard.

11.5 The method of earning i-mint points from i-mint merchants is subject to change from time to time.

11.6 Accumulation of both i-mint points and any other parallel rewards program points (of which the merchant may be a part) for the same transaction is at the sole discretion of i-mint merchant.

11.7 i-mint merchants may change any of the terms and conditions of their business at any time without notice to the i-mint member or to i-mint program. LSRL is not responsible for informing members of any such changes.

11.8 All members are required to obtain and preserve for a period of 180 days appropriate documentation for all transactions done with i-mint merchants that earn i-mint points. It is the member's responsibility to ensure that an EDC generated transaction slip of the correct amount and details of the transaction is provided to him/her at the time of transaction.

11.9 LSRL has no liability for the acts and omissions of the i-mint merchants.

12 i-mint points calculation

12.1 i-mint points accrued through transactions at i-mint merchants shall be credited to member's account within 7 working days.

12.2 i-mint points accrued through any other earn activity shall be credited to member's account within such period as is mentioned for such activity.

12.3 i-mint points credit is not applicable for the following: (i) returned & refunded goods and services, forfeited and unused services. (ii) goods or services acquired by using i-mint points.

12.4 Points are granted in whole. Customers will not be awarded points in fractions. Points will get rounded off to the nearest whole number.

12.5 i-mint points are valid for a period of three years or any other notified date. Points earned during any quarter of the year shall expire (on fifo basis) on completion of 3 years from the end of the quarter. Thus points earned during 1st july 2005 to 30th sept 2005 shall get expired on 1st October 2008.

12.6 In the event of the member not using his/her i-mint card to accumulate and/ or redeem
i-mint points for a continuous period of 24 months (2 years), the accumulated i-mint points and the i-mint membership account will expire. All points accumulated on such accounts and lying unused at the time of expiry shall lapse.

12.7 i-mint points from the member's account cannot be pooled or combined with the i-mint points of another member's account.

12.8 In case of earn activity with any i-mint merchants who participate in more than one program, subject to the consent of the i-mint merchants, the members are eligible for credit of points in more than one program.

12.9 Complaints on points not credited to account from any partner / merchant will be entertained only if the date of transaction is not older than 2 months.

13 Transfer of i-mint points

13.1 i-mint points are not negotiable, transferable or redeemable for cash. At no time may i-mint points be credited to or i-mint rewards request be issued to, purchased by, or sold to or otherwise transferred to any person other than the member. Any such i-mint points or requests for i-mint rewards are void if transferred for cash or other considerations. Any person who commits such acts is liable for damages, litigation and related costs to LSRL, which reserves the right, to terminate membership or remove such persons from i-mint network.

14 i-mint points statement, program updates & notices

14.1 Members can call the i-mint member care nos. Or register on www.imint.in in the member login section for obtaining an update of the i-mint points accumulated and/or used for i-mint rewards.

14.2 Any notice, information, intimation, change, modification, alteration of these terms and conditions or i-mint rewards catalog shall be deemed to have been given to the member after expiry of seven days, if notice is sent by pre-paid post to the last intimated address of the member or forthwith if posted on the website.

15 Redemption of i-mint points

15.1 i-mint points could be redeemed against the i-mint rewards catalog.

15.2 LSRL will maintain an i-mint rewards catalog on the website specifying the products and services which would be available for i-mint rewards against i-mint points accumulated by a member. Redemption against i-mint rewards catalog can happen by approaching the call center and placing a redemption request and/or through login in the i-mint website, when available.

15.3 All the items featured in the i-mint rewards catalog and/or informed by LSRL are subject to availability and suppliers warranties and restrictions at the time of claiming the i-mint rewards. In case an item selected by the member is not available, members will be required to select from the other available items from the i-mint rewards catalog. LSRL provides no warranty whatsoever with respect to those items or for their suitability for any purpose.

15.4 i-mint rewards once requested cannot be canceled or withdrawn or changed and the i-mint points used for the same cannot be reversed.

15.5 On receipt of the i-mint rewards request by LSRL through call center, website or otherwise, i-mint points will automatically be deducted from the accumulated i-mint points in the members account.

15.6 All reasonable efforts would be taken by LSRL to ensure that i-mint reward requests are fulfilled within 12 days of the receipt of the same at the call center or otherwise. LSRL will not be liable for any delay beyond the time period specified herein.

15.7 All requests issued for i-mint rewards are subject to any statutory regulations, rules and restrictions, if any.

15.8 i-mint rewards have no monetary refund value.

16 Termination of i-mint membership

16.1 A member may terminate his/her i-mint membership by calling the call center of the LSRL and requesting for termination.

16.2 Misuse of i-mint card or the membership benefits may result in termination of membership or withdrawal of benefits at the sole discretion of LSRL.

16.3 Disqualification of a member, arising out of his/her misconduct, fraud and misuse of i-mint rewards or acts in a manner inconsistent with any central/state/local laws, statutes or ordinances, may result in immediate termination of i-mint membership and cancellation of all i-mint points and i-mint rewards. Any member so disqualified shall not be entitled to redeem his i-mint points after such disqualification.

16.4 Upon the death of a member, his/her i-mint membership account will be closed and all outstanding i-mint points will lapse.

17 Miscellaneous

17.1 Settlement of disputes: terms and conditions, set herein, shall be governed by the laws of India only. All disputes arising under the terms and conditions subject to the exclusive jurisdiction of the competent courts in mumbai only. All claims and disputes arising under the terms and conditions should be notified to LSRL within 180 days after which no member shall have any claim against LSRL.

17.2 Changing these terms and conditions: LSRL reserves the right to change, at any time, these terms and conditions, features and benefits offered on i-mint.

17.3 LSRL shall have the right to transfer, assign and sell in any manner, in whole or in part, i-mint to any third party of its choice without reference or intimation to the members.

17.4 LSRL reserves the right to disqualify any person from further participation in i-mint if in LSRL's sole judgment such person has violated the terms and conditions specified herein.

17.5 i-mint membership enrollment and eligibility, earning i-mint points, claiming i-mint rewards, availability of i-mint rewards and redemption are subject to the terms and conditions herein and are subject to any applicable laws and regulations.

17.6 LSRL reserves the right to terminate i-mint, by giving one month's notice.

17.7 Upon termination or withdrawal of i-mint, all members will be given 30 days time within which they may use the i-mint points in their account to request for i-mint rewards, after which the i-mint points will lapse.

17.8 LSRL and i-mint merchants shall not be liable to any member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with i-mint, including the functioning of the helpline and/or the website, and/or provision or the refusal to provideh any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether LSRL and/or any of its i-mint merchants have any control over the circumstances giving rise to the claim or not.

18 Customer must always carry the i-mint card securely and should not share the information pertaining to his i-mint membership with anyone.

19 i-mint will not ask for customer password and other details through any e-mail or SMS. Please beware of spam mails and phishing and do not share your account details with mail id which appear to be coming from unauthorized sources.

20 In case a customer loses the i-mint membership card, a penalty of 50 points will be deducted from his / her points account in-case he / she wants a fresh card to be issued.

21 Customer must report the lost card details to the i-mint call center. Once a card is reported lost, it will be blocked and under any circumstances it will not be unblocked.

22 A fresh card can be issued to customer only when he / she verifies the other details of the account by calling up the call center. In case the customer fails to verify the details, the right of refusal for issuing the fresh card will remain with LSRL. No claims on such cases will be entertained.

23 Customer must call up the call center numbers to request for a fresh card. Requests on mail or other communication will not be entertained.

24 Customer must provide his complete name, address and other details while applying for a fresh card.

25 To combine his points from previous card to the new card, he / she will have to call up the call center and request for merging of points from one account to another. For more details on the process, a customer may call up the call center and understand the process better.

1. Earn

Earn 1 i-mint point on every Rs. 200 spent on fuel.

11. No points will be awarded for transactions using the redemption voucher.

12. More than two transactions in a day at HPCL outlets will be reversed.

Air India

 

1. On any transaction through Air India, the customer will earn 6 i-mint reward points for every rs.100. Only the basic fare will be taken for awarding i-mint points. The fare will be rounded off to the nearest rs.100 for awarding i-mint points. The points range will be different for different sectors and class of travel.

2. Customers can earn points on both the existing Air India FFP program as well as i-mint for traveling on Air India flights. However, these points cannot be used interchangeably.

3. In order to earn i-mint points on Air India, a member needs to provide their i-mint card number while booking the ticket or at the time of checking in. However, i-mint points will accrue to your account after 15 days of undertaking the travel.

4. The i-mint card is not meant for travel agents and would not be eligible for any loyalty points. In case it is found that a travel agent has accrued points by not disclosing his status as travel agent all the loyalty points so accrued will be cancelled.

5. The terms and conditions under this section are subject to change by the management of Indian at its own discretion.

6. The customer/user shall also be governed by the terms and conditions, disclaimers and privacy policy of Indian with respect to use of services of Indian.

7. On Air India, the member can earn i-mint points by quoting their i-mint card no. At the time of check-in at the check-in counter or on the website.

4. LSRL shall arrange to create necessary i-mint membership accounts for the active Debit card customers from 30th June 2007 as intimated by ICICI Bank to LSRL. LSRL shall arrange to link the respective Debit card account with i-mint membership account.

5. ICICI Bank Debit card customers  who have earned reward points can contact the i-mint call centre to check their membership and i-mint card status.

6. Customers shall have to link their Debit card account and enroll into i-mint membership to earn i-mint points from the ICICI Bank Debit card rewards program.

7. LSRL at its discretion decide the issuance of i-mint membership account and i-mint card.

16. Burn/redemption of the i-mint points will be allowed as per i-mint loyalty program redemption terms and conditions.

17. The linking of existing i-mint account to the ICICI Bank Credit Card account number will take at least seven (07) working days.

18. The other existing i-mint loyalty program and ICICI Bank Credit Card terms and conditions will apply.

19. Earn 2 i-mint points for every reward point you earn on select ICICI Bank Credit Card only. For other credit cards giving i-mint reward points the ICICI bank points will get transfered as 1.5 i-mint points.

Brand campaign terms and conditions

1. HPCL Campaign (hereinafter "Program") is offered by Loyalty Solutions and Research Pvt Limited (hereinafter "LSRL") a company having its Office at Florence Building, CTS 841 to 846, Nehru Road, Santacruz (East) Mumbai- 400055.

 

2. The Program, is valid for limited period till 31st March 2010 (hereinafter "Promotion Period").

 

3. The Program offers customer the opportunity to get imint gift voucher worth Rs 1000 plus bonus i-mint points.

 

4. The discounts offered to the customers through the gift vouchers are offered by the participating merchants and are applicable for redemption for select products only.

 

5. Discount gift vouchers may require the customers to buy a certain pre-stipulated value of the products from the issuing merchant partner.

 

6. Discount gift vouchers are redeemable against purchases and not exchangeable for cash either full or in part.

 

7.All bonus points for the Program shall be credited to the members’ i-mint account within 30 days from the end of the Program. 

 

8. i-mint points earned under the Program cannot be exchanged in lieu of any cash.

 

9. i-mint points offered to a card holder are neither assignable nor transferable under any circumstances.

 

10. The Program is optional and the members are not bound in any way to participate in the Program. Any such participation in the Program by the member is voluntary.

 

11. Employees and the families/relatives of LSRL, and their advertising agencies are not eligible to participate in the Program.

 

12.LSRL will not be responsible for any delay, misdirected, incomplete transaction made by the customer.

 

13. LSRL will not be responsible for any delay caused on account of settlements made by the merchant.

 

14. LSRL reserves its absolute right at any time to add, alter, modify or change or vary or withdraw any or all the terms and conditions stated herein and the same shall be binding on the member. Further LSRL at its sole discretion and without prior notice of any form, may choose to revoke the entire Program without having any liability/consequences whatsoever, towards the members or any other party.

 

15. The Program shall be subject to usual force majeure events and on occurrence of such event, the Program shall deem to be automatically withdrawn.

 

16. Any dispute arising out of or in connection with the or as a result of the Program shall be subject to the exclusive jurisdiction of the courts in Mumbai.

 

17. All other program terms and conditions as available on our website will apply. The terms and conditions are subject to India Law and exclusive jurisdiction of Mumbai Court.

 

18. Gift discount vouchers in the envelope are of value up to Rs.1000/-.

 

19. The gift discount vouchers are sourced from different issuing partners.

 

20. Gift discount vouchers are valid only on presentation of the i-mint card at the time of payments at the partner outlets.

 

21. Gift discount vouchers are of different denomination and are different in numbers for each envelope containing the gift vouchers.

 

22. The quality of the products purchased from i-mint partners is the responsibility of the brand and or the merchant partner and i-mint is in no way liable to any quality or quantity dispute or incongruencies.

 

23. i-mint membership cards are on invitational basis and the customer shall have to register himself/ herself to get the benefits of the membership.
